Intellectual Property Rights Protection Policy and Alleged Infringements

1.1 Intellectual Property Rights Protection Policy and Alleged Infringements

1.2 This document outlines Biz Trade Mart' policy ("Policy") for dealing with notifications of alleged infringements of intellectual property rights ("IPR"), in relation to materials available on Biz Trade Mart' websites or servers ("Alleged Infringement") by users of this website ("Users").

1.3 "Biz Trade Mart" refers to Publishers Representatives Limited (Hong Kong SAR) and its affiliates.

1.4 These procedures are designed to facilitate cooperation between Biz Trade Mart and Users. Biz Trade Mart does not determine the validity of IPR claims, nor does it endorse the display of any allegedly infringing materials by choosing not to act.

Our Handling of Alleged Infringement

2.1 IPR owners or their agents ("Complainants") should complete and sign the IP Complaint Notice in Schedule 2 to report an Alleged Infringement.

2.2 Biz Trade Mart will process the notice per the procedures outlined in Schedule 1.

2.3 Biz Trade Mart may revise these procedures at any time.

2.4 Biz Trade Mart reserves the right not to take any further action in respect of the Alleged Infringement if the IP Complaint Notice as prescribed in Schedule 2 is not submitted, is insufficient or is incomplete, and/or the Relevant Information (as defined in Clause 3.1 below) is not provided as required or is insufficient or is incomplete, and/or any of the Procedures stipulated in Schedule 1 are not complied with by the Complainant.

3. Relevant Information

3.1 The Complainant shall provide Biz Trade Mart with all the necessary documentation and other relevant information in respect of the Alleged Infringement (“Relevant Information”), including, inter alia:

3.1.1
  • Evidence of the Complainant’s ownership of the IPR alleged to have been infringed, which may include:
    • Copyright: Registration certificates, proof of creation, publication, and ownership.
    • Trademark: Certificate of registration and related documents from relevant authorities.
    • Patent: Certificate of patent grant, including claims, specifications, drawings, and supporting reports.
    • Registered Design: Certificate of registration from relevant authorities.
    • Any other appropriate evidence as determined by Biz Trade Mart at its discretion.

    3.1.2 Certificate of due incorporation or registration of the Complainant company (if applicable).

    3.1.3 Evidence of the infringement, such as website links, photos, samples, brochures, contracts, or invoices.

    3.1.4 Final court or arbitration judgments, orders, or settlements against the Alleged Infringer, or other legally recognized documents validating the infringement in the Relevant Territory.

    3.1.5 Any other relevant documentation or information that Biz Trade Mart may require.

    Relevant Territory

    4.1 For the purpose of this Policy, "Relevant Territory" shall mean the country / region where (i) the Alleged Infringement takes place or is likely to take place; (ii) the allegedly infringing products are manufactured; or (iii) the allegedly infringing products are advertised, offered or sold.

    5. Indemnity
